Hi. A newly hired employee already gave birth before she could even render her first day of service in an agency. Is she entitled to avail 105 days of maternity leave?

It depends on her date of assumption. Her official start of government service is her date of assumption. If she belonged to a private office before being employed in the government and was already on maternity leave, then the leave law applies. Otherwise, she cannot be entitled nor file for leave unless she already assumed to her post.
