Scenario : Mr.A is a government employee ,he got stroke last December 2020, he decided to retire ,June 2020.from January -May he filed a sick leave of absence which is a leave without pay..my question is ,is he entitled for a leave credits every month even he incurred leave eof absence without pay due to sickness,his vacation leave is also zero, also is he entitled for salary on the holidays and suspension of work such as typhoon?thank you

However, if both SL and VL credits are exhausted, the employee shall be deemed on Leave Without Pay (LWOP) and shall not earn leave credits nor be paid during that period. On this instance, the employee shall not earn leave credits while on LWOP no be paid with his salary. Corollary, LWOP shall only be applied on Work Days. Therefore, during weekends, holidays, work suspensions, and the like where attendance is not required, the employee shall not be on LWOP and shall not be deducted accordingly.
